Welcome to NestNet. These Terms & Conditions govern your access to and use of our guest WiFi marketing services (“Service”).

1. Information We Collect

When you connect to the guest WiFi, we may collect the following information:

  • Name
  • Email address
  • Phone number (if provided)
  • Device type and MAC address
  • Connection timestamps (when you log on/off)

This information is collected on behalf of the business providing the WiFi.

2. How Your Information is Used

Your information may be used to:

  • Send promotional emails or SMS messages from the business (offers, events, news, etc.)
  • Analyze visit frequency and behavior (e.g. how often you return)
  • Improve service quality and marketing efforts

We do not sell your personal data.

3. Your Consent

By logging into the guest WiFi, you agree to:

  • Share your contact information with the business
  • Receive marketing emails and/or text messages
  • Allow data tracking for marketing and analytics

You may opt out of marketing at any time using the unsubscribe link in emails or by replying STOP to text messages.

4. Data Sharing

Your information is shared only with:

  • The business offering the WiFi
  • NestNet, the platform providing the data collection and marketing tools

We do not sell, rent, or share your data with third parties for unrelated marketing.

5. Data Retention

Your data will be stored securely and retained only as long as necessary to fulfill the marketing purpose or as required by law.

6. Your Rights

Depending on your location, you may have the right to:

  • Request access to your data
  • Request correction or deletion
  • Opt out of communications at any time

2. Our Services

We provide a marketing platform for local businesses to:

  • Capture customer contact info via guest WiFi
  • View and analyze visitor behavior
  • Automate marketing through email and SMS

3. User Responsibilities

You agree to:

  • Collect and use guest info only with proper consent
  • Comply with all laws including:
    • TCPA: Requires opt-in for SMS messaging
    • CAN-SPAM: Requires opt-out options for email
    • GDPR/CCPA: Respect data access and deletion requests
  • You are solely responsible for your campaigns and content sent using NestNet’s platform.

4. Subscription & Billing

  • Plans are billed monthly unless canceled before the next cycle.
  • No refunds for unused time.
  • Payment failure may result in account suspension.

5. Termination

We may suspend or terminate access for violations or misuse. You may cancel at any time.

6. Limitation of Liability

NestNet is not liable for:

  • Third-party service interruptions
  • Legal actions arising from your misuse of collected data
  • Indirect or consequential damages

7. Modifications

We reserve the right to change or discontinue any feature or service at any time.

8. Governing Law

These Terms are governed by the laws of the State of Utah, USA.

Payment Terms and Conditions

Effective Date: 30th June 2025

By subscribing to and using NestNet’s services, you agree to the following terms and conditions:

1.⁠ ⁠Billing & Payment Terms

  • • Services are billed monthly in advance on a recurring basis.
  • • Payment is due on the same calendar day each month as the original signup date (e.g., if you sign up on the 5th, you’ll be charged on the 5th of each month).
  • • Payments are processed via [Insert Payment Method – e.g., Stripe, ACH, credit card].
  • • Failure to make timely payment may result in service suspension or termination.

2.⁠ ⁠Cancellation Policy

  • • You may cancel your subscription at any time by providing written notice at least 30 days prior to your next billing date.
  • • Cancellations must be submitted via email to support@nestnetmarketing.com.
  • • Service will remain active for the duration of your current billing cycle and terminate at the end of the 30-day cancellation period.
  • • No refunds will be issued for partial months or unused time within a billing cycle.

3.⁠ ⁠Service Changes

NestNet reserves the right to modify service features, pricing, or policies with 30 day's written notice to subscribers.

4.⁠ ⁠Limitation of Liability

  • • NestNet will not be held liable for any indirect, incidental, or consequential damages resulting from service use or interruptions.
  • • Service is provided “as is” and without warranties of any kind, express or implied.
